1. Acceptance of these Terms

This website (the “Site”) is operated by Charred Oak Premium Spirits (“Charred Oak,” “we,” “us,” or “our”), a retailer of alcoholic beverages located at 2900 E University Dr, Ste 125, Auburn, Alabama 36830. By accessing, browsing, or otherwise using the Site — including by confirming that you are 21 years of age or older on our age-verification prompt — you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and by our Privacy Notice. If you do not agree, you must not use the Site.

We may update these Terms at any time. Changes take effect when posted, and your continued use of the Site constitutes acceptance of the updated Terms.

2. Age requirement — you must be 21 or older

You must be at least twenty-one (21) years of age to view or use this Site. By entering, you represent and warrant that you are 21 or older and that it is lawful for you to view content regarding alcoholic beverages in your jurisdiction.

Charred Oak does not sell, serve, or furnish alcoholic beverages to anyone under 21, to any person who cannot produce valid identification, or to any person who appears intoxicated. Valid, government-issued photo identification is required for every alcohol purchase, in store, without exception. We reserve the right to refuse service to anyone, at our sole discretion, for any lawful reason.

3. Informational site — no online sales

The Site is provided for general informational purposes about our store, hours, location, events, barrel picks, and the categories of products we carry. The Site is not an online store: no orders, payments, reservations, or sales of alcohol are transacted through this website. All purchases occur in person at our licensed retail location, subject to Alabama law and the regulations of the Alabama Alcoholic Beverage Control Board.

Any hold request, special order, allocation request, barrel-pick reservation, catering or event inquiry made by phone, email, social media, or through a form on this Site is a request only. It is not a contract, it is not confirmed until we accept it directly, and it is completed only when you purchase the item in store. We may decline or cancel any such request at any time before purchase.

4. Products, pricing, and availability

Product selection, inventory counts, sizes, proofs, vintages, packaging, images, and pricing shown or referenced on the Site are provided in good faith but may be inaccurate, incomplete, out of date, or unavailable, and are subject to change without notice. Counts and category figures are approximate.

Product photography on the Site may include studio representations produced from photographs of the item. Labels, packaging, vintages, batch and barrel details may differ from the bottle on our shelf.

In the event of a pricing, description, or availability error, we reserve the right to correct it and to decline or cancel any request based on that error, including after a request has been acknowledged. The price and availability confirmed at the register at the time of an in-store purchase control.

Allocated and limited products are subject to quantity limits and to our discretion in allocating them. Nothing on this Site is an offer to sell, and no listing reserves any item for any person.

5. All sales final

Consistent with Alabama law and ABC regulations, alcoholic beverages may not be returned or exchanged once they leave the store, except where a product is defective and the return is permitted by law. Please inspect your purchase before you leave.

6. Responsible enjoyment

Charred Oak supports the responsible consumption of alcohol by adults of legal drinking age. Please do not drink and drive, and never furnish alcohol to anyone under 21. 7. Third-party names, marks, and content

Brand names, distillery names, product names, and label images referenced on the Site are the trademarks of their respective owners and are used to identify products we sell. Their appearance does not imply any endorsement, sponsorship, or affiliation between those owners and Charred Oak. Customer reviews reproduced on the Site are the words of the reviewer and are published as written.

8. Links to other sites

The Site may link to third-party websites, including mapping, social media, and review platforms. We do not control those sites and are not responsible for their content, their accuracy, or their privacy practices. Following a link is at your own risk.

9. Acceptable use

You agree not to use the Site to violate any law; to misrepresent your age or identity; to scrape, harvest, or copy content in bulk; to attempt to gain unauthorized access to any system; to interfere with the operation of the Site; or to submit false, abusive, or unlawful content through any form on the Site.

10. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any information on the Site is accurate, complete, or current.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHARRED OAK PREMIUM SPIRITS, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO your access to or use of (or inability to use) the Site, any content on it, or any product referenced on it — whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.

Nothing on the Site constitutes medical, legal, or professional advice. You are solely responsible for your own conduct and for the lawful and responsible use of any product you purchase. To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Site shall not exceed one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Charred Oak Premium Spirits and its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

13. Intellectual property

The Site and its contents — including text, graphics, logos, the Charred Oak Premium Spirits name and marks, photographs, product imagery, and layout — are the property of Charred Oak or its licensors and are protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, republish, or create derivative works from any part of the Site without our prior written permission.

14. Governing law and disputes

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Lee County, Alabama, and you consent to the personal jurisdiction of those courts.

Any claim must be brought within one (1) year after it arises, or it is permanently barred.

15. Severability and entire agreement

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the remaining provisions will remain in full force. These Terms, together with our Privacy Notice, are the entire agreement between you and Charred Oak regarding the Site.
